...position on the NY law itself - I dont know enough - but what I *do* know is the court has no set jurisprudence. History dictates sometimes but not others. History is invoked falsely. States rights, unless not. It's a mishmash driven by policy preferences of an activist court.

A) Gillibrand on SCOTUS: This is clearly an activist Supreme Court. We've seen a draft decision that intends to undermine Roe. We have a decision undermining states rights where they want to protect its citizens. It's an outrage.
States rights was made up because of slavery. It's not a thing. We are not a Confederacy. The reason they waffle is because they're not for states rights, they were just for segregation. Just like now they are for forcing women to have unwanted pregnancies. They have no code!
